Terms of service

Effective date: October 31, 2026.

1. About these Terms

Elysiums Luxe is owned and operated by MDM Global LLC ("we", "us"). These Terms of Service govern your use of elysiumsluxe.com (the "Website") and every purchase you make from us. Our Shipping Policy, Return and Refund Policy and Privacy Policy form part of these Terms. By using the Website or placing an order, you agree to these Terms. The version in effect on the date of your order applies to that order.

2. Eligibility

You must be at least 18 years old and able to enter a binding contract. If you buy for a business, you confirm you have authority to bind it.

3. Accounts

If you create an account, keep your details accurate and your login private. You are responsible for activity under your account and should tell us promptly about any unauthorized use.

4. Orders, pricing and availability

  • Your order is an offer to buy. A contract forms when the order leaves the maker or our warehouse, not when you receive an order confirmation email.
  • All products are subject to availability. Some items are sold on pre-order or made to order, and the product page says so with the expected timing.
  • Prices may change without notice before you order. If a price, description or availability is listed in error, we may cancel the affected order and refund you in full, even after confirmation.
  • We may refuse or cancel an order for suspected fraud, payment problems or delivery restrictions, with a full refund of anything paid.
  • Payments are processed by secure third-party providers. You agree to provide accurate billing details.

5. Delivery, title and risk of loss

Delivery is described in our Shipping Policy. Title and risk of loss pass to you when the order is handed to the carrier. This does not reduce the help we give with damage, loss and missing-item claims under our Shipping Policy and Return and Refund Policy.

6. Returns, refunds and cancellations

Returns, refunds, cancellations and delays are covered by our Return and Refund Policy.

7. Product information and changes by the maker

We describe products using information published by their makers. Makers may update designs, components, colors, dimensions or specifications without notice, and images may show options or settings that are not included. Small variations are not defects. If a change materially affects an item you have ordered before it leaves, we will tell you, and you may cancel for a full refund.

8. Warranty

Elysiums Luxe does not make or provide a warranty of its own on the products we sell. Any warranty on a product is given by its manufacturer, on the manufacturer's own terms, length and claim process, and the manufacturer alone is responsible for it. If you have a warranty question, contact us first and we will help you raise it with the manufacturer.

TO THE EXTENT PERMITTED BY LAW, ELYSIUMS LUXE DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. Some states do not allow implied warranties to be excluded, so this may not apply to you, and you may have other rights that vary by state.

9. Health and safety

The products we sell are general wellness equipment. They are not medical devices and are not intended to diagnose, treat, cure or prevent any disease. Nothing on the Website, including product descriptions and customer reviews, is medical advice.

Cold water immersion, heat and sauna use carry real risks, including cold shock, hypothermia, overheating, dehydration, fainting and changes in heart rate and blood pressure. Talk to your doctor before use, especially if you are pregnant, have a heart, blood pressure or circulatory condition, or take medication. Follow the maker's instructions, time limits and safety warnings, do not use the equipment under the influence of alcohol or drugs, and keep children and pets away from equipment, covers and electrical connections. To the extent permitted by law, you use the products at your own risk.

10. Installation, site and electrical

Before you order, you are responsible for confirming that the item fits your space, delivery route and foundation, and that your power supply meets the electrical requirements stated on the product page. Electrical connections, dedicated circuits, permits, homeowners' association approvals and local code compliance are your responsibility, and hardwired or 240V equipment should be connected by a licensed electrician. We do not install products and are not responsible for damage or injury arising from installation, site preparation or work carried out by others.

11. Reviews and third-party content

Reviews labelled as from the maker's customers are shared by the maker and describe individual experiences. We do not verify them, individual results vary, and they are not medical advice or a statement by us about what a product will do for you. Links to third-party websites are provided for convenience; we are not responsible for their content.

12. Intellectual property

Content on the Website (text, images, logos and graphics) belongs to Elysiums Luxe or its suppliers and is protected by law. You may use the Website for personal, non-commercial purposes only, and may not copy, reproduce or resell its content or use our trademarks without permission.

13. Your content

If you submit content such as a review, photo or message, you confirm you have the right to do so and grant us a non-exclusive, worldwide, royalty-free license to use it. Do not submit content that is unlawful, misleading or infringes anyone's rights.

14. Prohibited activities

You agree not to use the Website unlawfully, interfere with its operation, attempt unauthorized access to our systems, or buy for resale without our written agreement.

15. Disclaimers

The Website is provided "as is" and "as available". We do not guarantee that it will be uninterrupted or error-free. Product warranties are covered only by section 8.

16. Limitation of liability

To the fullest extent permitted by law, Elysiums Luxe and MDM Global LLC are not liable for indirect, incidental, special or consequential damages, or for lost profits or data, arising from the Website, any product or these Terms. Our total liability for any claim relating to an order is limited to the amount you paid for that order. Nothing in these Terms limits liability that cannot be limited under applicable law.

17. Indemnification

You agree to indemnify and hold harmless Elysiums Luxe, MDM Global LLC and their affiliates from claims arising from your misuse of the Website or products, your breach of these Terms, or your infringement of anyone's rights.

18. Termination

We may suspend or end your access to the Website if you breach these Terms.

19. Governing law

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law rules.

20. Dispute resolution

Informal resolution. Please contact us first at support@elysiumsluxe.com and allow 30 days for us to try to resolve the matter.

Arbitration. If it is not resolved, the dispute will be settled by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules.

Class action waiver. Disputes are resolved individually, not as part of a class or representative action.

Exception. Either party may bring a qualifying claim in small claims court.

21. Changes to these Terms

We may update these Terms. Changes apply to orders placed and use of the Website after the update is posted.

22. General

If any provision is found invalid, the rest remain in effect. These Terms, with the policies named in section 1, are the entire agreement between you and us about their subject. Our failure to enforce a provision is not a waiver of it.
